1. Definitions

When the following words are used in these Terms, this is what they will mean.

  • "Services" means the provision of an online portal allowing Prospective Candidates for employment positions to display their curriculum vitae, personal and employment details for viewing by Prospective Employers and for Prospective Employers to find and download information about a Prospective Candidate.
  • "Register" means registering as either a Prospective Candidate or a Prospective Employer for the provision of the Services and "Registered" refers to a user who has applied to Register and has been accepted as a Registered User on our site.
  • "our site" means the website through which our Services are provided which is currently at http://www.theconnectionclub.co.uk/
  • "Group" means the subsidiaries or holding company and its subsidiaries of any company as defined in Section 1159 of Companies Act 2006 as amended varied or replaced from time to time.
  • "we/our/us" the Connection Club Limited a company incorporated and registered in England & Wales under company number 06663275 which has its registered office at Orchard House Portfield Farm, Newport Pagnell, Milton Keynes, Buckinghamshire, MK16 8NG.
  • "Registered User" means a Prospective Candidate or Prospective Employer who has completed the registration process on our site and has been accepted by us.
  • "Prospective Candidate" a person who is looking for or potentially looking for new employment.
  • "Prospective Employer" means a business which is looking for or potentially looking for a new Prospective Candidate to recruit into their business or the business of a member of their Group or a client of their business.
  • "Registration" means the process of becoming a Registered User on our site.
  • "Renewal" means the process of renewing your status as a Registered User following expiry of the initial fixed term and "Renew" shall be construed accordingly.
  • "Basic Details" means the basic information about a Prospective Candidate but which will not be sufficient so as to identify the Prospective Candidate to third parties.
  • "Further Details" means such of the Prospective Candidates curriculum vitae, profile video, and social media information as the Prospective Candidate shall upload to our site from time to time.
  • "Our Fee" means the fee payable to us for use of our site for the relevant period as stated in Clause 4.7.

When we use the words "writing" or "written" in these Terms, this would include email unless we say otherwise

 

2. Use of this site

  • If you are a Prospective Candidate our site is provided to you for your personal use subject to these Terms. By using our site you agree to be bound by these Terms.
  • If you are a Prospective Employer you confirm that you will use our site in connection with the recruitment of employees for your business only or that of any business of your Group or a client of your business.

 

3. Amendments

We may update these Terms from time to time for legal or regulatory reasons or to allow the proper operation of our site.  Any changes will be notified to you via the email address provided by you on registration or via a suitable announcement on our site.  The changes will apply to the use of our site after we have given notice.  If you do not wish to accept the new Terms you should not continue to use our site.  If you continue to use our site after the date on which the change comes into effect, your use of our site indicates your agreement to be bound by the new Terms.

 

4. Registration

  • To register on our site, you must be over eighteen years of age.
  • You must ensure that the details provided by you on Registration or at any time are correct and complete.
  • You must inform us immediately of any changes to the information that you provided when Registering by updating your personal or contact details in order that we can communicate with you effectively.
  • There are three types of user of our site:
  • a non-registered user is a user that has not registered their details with us and therefore has limited access to the Services that our site provides. A non-registered user is able to see only Basic Details and is not able to request any Further Details in respect of any Prospective Candidate.
  • A Prospective Candidate Registered User is a user that has paid Our Fee for the current period and has submitted their profile details in the Registration process, which we have accepted. A Prospective Candidate Registered User has full access to all public areas of our site and whose Basic Details will appear in appropriate searches carried out by a Prospective Employer and whose Further Details will be available to a Prospective Employer to download.
  • A Prospective Employer Registered User who is a user that has paid Our Fee and is able to view the Basic Details of a Prospective Candidate and request to download the Further Details of a Prospective Candidate where available.
  • If you choose to become a Registered User then the registration fee shall be paid on a wholly non-refundable basis in accordance with Clause 4.6 save as provided at clause 4.8 below.
  • Your status as a Registered User shall continue for the initial fixed term stated in the Registration process at which time you will cease to be a Registered User and your access as such to our site will end unless and until you Renew as a Registered User and pay Our Fee. A Prospective Employer Registered User who has requested any Further Details will have access to such Further Details for a period of 14 days after the expiry of their Registered User status.

 

Our Fee payable by you is:

If you are a Prospective Candidate:

  • $25 for your Basic Details to be displayed and your Further Details to be available on our site for a period of two weeks from Registration or Renewal (as appropriate); and
  • $40 for your Basic Details to be displayed and your Further Details to be available on our site for a period of four weeks from Registration or Renewal (as appropriate).

If you are a Prospective Employer such fee as we shall agree with you from time to time during the Registration process or any Renewal.

  • We reserve our right to refuse to accept any details submitted in your Registration or within your profile, including user names, email addresses, names, photographs videos, curriculum vitaes or any other details that we in our sole and unfettered discretion deem to be unsuitable or believe not to be genuine

 

5. Password and Security

5.1 When you register to use our site, you will be asked to create a password.  In order to prevent fraud, you must keep this password confidential and must not disclose it or share it with anyone.  If you know or suspect that someone else knows your password you should notify us by contacting info@theconnectionclub immediately.

5.2 If we have reason to believe that there is likely to be a breach of security or misuse of our site we may require you to change your password or we may suspend your account.

 

6. Intellectual Property

The content of our site is protected by copyright, trademarks, database rights and other intellectual property rights.  You may retrieve and display the content of our site on a computer screen, store such content in electronic form on disk (but not any server or other storage device connected to a network) or print one copy of such content for your own personal, non-commercial use, provided you keep intact all and any copyright and proprietary notices.  You may not otherwise reproduce, modify, copy or distribute or use for commercial purposes any of the materials or content on our site without our written permission.

 

7. Your use of our site

You may not use our site for any of the following purposes:

  • disseminating any unlawful, harassing, libellous, abusive, threatening, harmful, vulgar, obscene, or otherwise objectionable material or otherwise breaching any laws;
  • transmitting material that encourages conduct that constitutes a criminal offence, or otherwise breaches any applicable laws, regulations or code of practice;
  • interfering with any other person's use or enjoyment of our site; or
  • to knowingly introduce viruses, Trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to our site, the server on which our site is stored or any server, computer or database connected to our site.  You must not attack our site via a denial of service attack or a distributed denial of service attack.  By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990.  We will report any such breach to the relevant law enforcement authorities and we will cooperate with those authorities by disclosing your identity to them.  In the event of such breach your rights to use our site will cease immediately.

We reserve the right, without being required to refund Our Fee to you, to refuse permission for any material to be posted on our site or to remove any material in any circumstances which we, in our sole discretion, think fit.

You will be responsible for and will indemnify us for all losses and costs that we may suffer resulting from your breach of these Terms.

Whenever you make use of a feature that allows you to upload content to our site, or to make contact with other users of our site, you must comply with the content standards that are in our Acceptable Use Policy http://www.theconnectionclub.co.uk/view/acceptable-use-policy

You warrant that any such contribution does comply with those standards, and you would be liable to us and indemnify us for any breach of that warranty.  If you are a consumer user, this means you would be responsible for any loss or damage we suffer as a result of your breach of warranty.

Any content you upload to our site will be considered non-confidential and non-proprietary, and we have the right to use, copy, distribute and disclose to third parties any such content for any purpose.

We also have the right to disclosure your identity to any third party who is claiming that any content posted or uploaded by you to our site constitutes violation of their intellectual property rights, or of their right to privacy.

We will not be responsible, or liable to any third party, for the content or accuracy of any content posted by you or any other user of our site.

We have the right to remove any posting you make on our site if, in our opinion your post does not comply with the contents standards set out in our Acceptable Use Policy http://www.theconnectionclub.co.uk/view/acceptable-use-policy

The views expressed by other users on our site do not represent our views or values.

If you are a Prospective Candidate we will use our reasonable endeavours to ensure that your Further Details are not available for download by any company, business or organisation that you notify to us during the Registration process as blacklisted employers.

 

8. Availability of the Site

  • Although we aim to offer you the best service possible, we make no promise that the Services will meet your requirements. We cannot guarantee that the Services will be fault free.  If a fault occurs with our site you should report it to info@theconnectionclub and we will attempt to correct the fault as soon as we reasonably can.
  • Your access to our site may be occasionally restricted to allow for repairs, maintenance or introduction of new facilities or services. We will attempt to restore the Services as soon as we reasonably can.
  • You may link to our home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it.
  • You must not establish a link in such a way as to suggest any form or association, approval or endorsement on our part when none exist.
  • You must not establish a link to our site and any website that is not owned by you.
  • Our site must not be framed on any other site, nor may you create a link to any part of our site other than the home page.
  • We reserve the right to withdraw key information without notice.

9. The Company's right to suspend or cancel your Registration or refuse or remove the information posted on our site

  • We may suspend or cancel your Registration immediately at our reasonable discretion or if you breach any of your obligations under these Terms.
  • You can cancel your Registered User Status at any time by informing us at info@theconnectionclub but in doing so you will not be entitled to receive any refund of Our Fee.
  • If you are a Prospective Candidate you accept that the nature of the Services is such that once you pay Our Fee and submit your Registration your Basic Details and Further Details will appear on and be available through Our Site and as such you shall have begun to provide the Services. You therefore agree that you will not have a right to cancel the agreement for the provision of the Services pursuant to the Consumer Protection (Distance Selling) Regulations 2000.
  • The suspension or cancellation of your Registered User status and your right to use our site shall not affect either party's statutory rights or liabilities.
  • We may refuse or remove any information, photographs or documentation that you have posted on our site for any reason that we think fit

 

10. The Company's liability

  • Our site may provide content from other Internet sites or resources and while we try to ensure that material included on our site is correct, reputable and of high quality, we do not give any warranties or make any guarantees in relation to that content. If we are informed of any inaccuracies in the material on our site we will attempt to correct the inaccuracies as soon as we reasonably can.
  • We have no control over the truth or accuracy of information posted on to our site by Registered Users and we accept no responsibility for the behaviour of the Registered Users in their use of our site.
  • We provide no guarantee or warranty that our site is free from viruses or errors and we accept no liability for any loss or damage caused by any virus or error contained on our site.
  • Use of our site and any of the materials contained or posted on our site are at the users' own risk and we accept no liability for any loss or damage suffered as a result of use of our site or its contents.
  • Nothing in these Terms excludes or limits our liability for death or personal injury arising from our negligence, or our fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by English law.
  • To the extent permitted by law, we exclude all conditions, warranties, representations or other terms which may apply to our site or any content on it, whether express or implied.
  • We will not be liable to you or any user of our site for any loss or damage, whether in contract, tort (including negligence) breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with:
  • Use of, or inability to use, our site; or
  • Use of or reliance on any content displayed on our site.

 

If you are business user, please note that in particular, we will not be liable for:

  • Loss of profits, sales, business or revenues;
  • Business interruption
  • Loss of anticipated savings
  • Loss of business opportunity, goodwill or reputations; or
  • Any indirect or consequential loss or damage.

We will not be liable for any loss or damage caused by a virus, distributed denial of service attack, or other technologically harmful material that may affect your computer equipment, computer programmes, data, or other proprietary materials due to your use of our site or to your downloading of any content on it, or any website linked to it.

We shall accept no responsibility for any loss occasioned by the unlawful use of credit cards to purchase any Services from our site.

 

11. Advertising and sponsorship

A part of our site may contain advertising and sponsorship.  Advertisers and sponsors are responsible for ensuring that material submitted for inclusion on our site complies with relevant laws and codes.  We will not be responsible to you for any error or inaccuracy in advertising and sponsorship material.

 

12. Applicable Law

These Terms will be subject to the laws of England.  We will try to resolve any disagreements quickly and efficiently.  If you are not happy with the way we deal with any disagreement and you want to take Court proceedings, you must do so through the English Courts.

 

13. International use

We make no promise that materials on our site are appropriate or available for use in the locations outside the United Kingdom, accessing our site from territories where its contents are illegal or unlawful is prohibited.  If you choose to access our site from locations outside the United Kingdom, you do so on your own initiative and are responsible for compliance with local laws.

 

14. Miscellaneous

  • You may not transfer any of your rights under these Terms to any other person. We may transfer our rights under these Terms to another business where we reasonably believe your rights will not be affected.
  • If you breach these Terms and we choose to ignore this, we will still be entitled to use our rights and remedies at a later date or in any other situation where you breach the Terms.
  • We shall not be responsible for any breach of these Terms caused by circumstances beyond our reasonable control.

15. Severability of clauses

If any term of these Terms is held by a Court or other competent authority to be invalid or unenforceable in whole or in parts the validity of the other provisions of the Terms and the remainder of the term in question shall not be affected.
